RULES THE ORGANIZER The organizer of the Area Travel Video Contest is Area Media Inc. The organizer, employees of the organizer, and any of the official partners and sponsors of the organizer relating to the competition and their families are not eligible to enter the competition. ELIGIBILITY The competition is open to anyone 18 years of age or older who are not prohibited by any law or regulation from entering and who have access to the Internet. No entry fee or other payment is required to enter, nor is the purchase of any item or service necessary. A video that has won a prize in a national or international competition or that has been used for commercial purposes (i.e. generated payment) is not eligible for entry. The organizers reserve the right at their sole discretion to reject any videos which are deemed to be offensive, obscene, defamatory or in any other way inappropriate or incompatible with the competition. ENTRY PROCEDURE Entries must be submitted online after June 9th, 2008 and before the closing date of August 31st, 2008 in accordance with the instructions set out on www.area-daily.com. By submitting an entry entrants will be deemed to have fully read these terms and conditions and agreed to be bound by them. There is no limit to entries per person. Videos must be about interesting travel experiences and adventures, hidden discoveries, and memorable places and things to see and do around the globe. Videos must be 3 minutes or less. DISPLAY OF THE VIDEOS By submitting a video to the competition all entrants agree to the video being displayed, together with the entrant’s name, city, state, country, title of the submission, and brief description of the submission on www.area-daily.com. JUDGING The editors of Area Media Inc. will determine the shortlisted entries and winner of the competition. The judging criteria will include: content, creativity and originality. The decision of the judges is at their sole discretion and in each case is final and binding. The organizers will not enter into any discussion or correspondence regarding the judging or organization of the competition. PRIZES There will be one overall winner of the competition who will win their choice of one of two Design Hotel giveaways, as listed on www.area-daily.com. The accommodation must be taken by November 30, 2008. The organizer is not responsible for paying any costs, travel or other expenses incurred by a prize winner or companion that are not stated to be included in the prize. The organizers reserve the right to change or add to the prizes and substitute them with a comparable alternative due to unforeseen circumstances or circumstances beyond their control. Any changes will be posted on the competition web-site. Prizes are non-transferable and no cash equivalent will be offered. NOTIFICATION The prize winner will be announced on the competition web-site by September 7, 2008 and notified by e-mail. The prize winner will be responsible for ensuring that they can accept their prize and if they cannot then the organizers reserve the right to withdraw it. The prize winner will co-operate fully with the organizer in organizing the accommodation by the stipulated date and will supply confirmation of identity and all necessary personal and other information. It is the responsibility of the prize winner to have a valid Passport, visa and driving license (if applicable). COPYRIGHT It is a condition of entry to the competition that each video submitted to the competition is the original work of the entrant and that the entrant owns full unconditional worldwide copyright and all other intellectual rights in it. By submitting any such video each entrant warrants to the organizer that it does not infringe the privacy, copyright or other intellectual property rights of any third party. USE OF THE VIDEOS BY THE ORGANIZER It is a condition of entry to the competition that in relation to each video submitted to the competition the entrant thereby grants to the organizer a non-exclusive, perpetual, irrevocable, royalty free, transferable, worldwide license to use, copy, publicly display, distribute, sub-license, modify, make derivative works and otherwise fully exploit such video for all commercial purposes, including marketing and promotion of Area Media Inc., through any media outlet and in any format without attribution of copyright to the entrant and without any payment, compensation or permission. LIABILITY Videos are uploaded onto the competition web-site at the entrant’s risk and the organizers cannot accept any liability for the unauthorized duplication or use of videos submitted to the web-site. The organizer will not be liable for technical, hardware or software failures of any kind or lost or unavailable network connections which may limit or prohibit an eligible entrant's ability to participate in the competition. Other than death or personal injury arising from the acts or omissions of the organizer or its employees, the organizer will not be liable for any loss or damage arising out of a prize winner’s participation in the prize and cannot accept any liability for the accommodation which is the sole responsibility of the supplier of the service. It is the responsibility of the prize winner to ensure that they have adequate travel and any other relevant insurance. ORGANIZER Area Media Inc. video@area-daily.com
